Over 15,000 complaints were received by the UK Information Commissioner’s Office last year regarding the handling of Data Subject Access Requests. Also recently, the regulator has taken action against two local authorities and seven organisations for failing in their duty to respond to DSARs in line with legislative requirements. Individuals having the right to access their personal data is not new and even existed well before the introduction of GDPR in 2018, so why are organisations still struggling to handle DSARs effectively and efficiently? A particular area of concern, and quite often contention, is the way in which employers handle DSARs. To support employers, the ICO published specific DSAR guidance earlier this year.
