People diagnosed with mesothelioma are set to benefit from considerably easier access to compensation under new legislation expected later in 2026, in a welcome development for sufferers and their families. 

Claims for compensation relating to mesothelioma, like nearly all other personal injury claims, operate under a strict limitation period of three years. This means that proceedings must be raised within three years or the case will be time barred; effectively lost on the principal that the action was not brought forward in a timely fashion. The difference with mesothelioma cases and similar types of cancers, is that the clock for the three-year period can begin and run out before a person even knows they have the disease. 

As this is the case for many people suffering from mesothelioma, the three-year time limit causes a real issue when considering their claim for compensation and potentially leaves them with no legal remedy through no fault of their own.  

It is expected that the new legislation will clarify when the three-year time limit for raising a claim begins. This will make it easier for the injured person and their solicitors to confidently assess the prospects of a case and confirm whether it has time barred or not.
