Employers’ Duties

Employers’ Duties

All employers of foreign nationals, whether sponsorship licence holders or not, have a duty to ensure that all employees within their business have a right to work in the UK. Employers are expected to retain on file proof of eligibility to work for each employee and conduct ‘illegal working checks’.

There are additional reporting and recording duties on businesses that hold sponsorship licences.  These have to be managed regularly through the Sponsorship Management System.

Failure to carry out these duties can result in criminal prosecution and/or the imposition of civil penalties.

How can Thorntons help?

At Thorntons, our specialist Immigration Law team can advise you, as an employer, on your duties when employing foreign nationals. We can also help you in challenging civil penalties and dealing with immigration checks.

In most immigration situations taking legal advice early on can often resolve a situation quickly, avoid potential problems and save you time and money later. With our proactive and commercial business legal advice, our immigration solicitors can help find the right solution for your business when dealing with employing foreign workers, and immigration and employment law issues.
