All employers of foreign nationals, whether sponsorship licence holders or not, have a duty to ensure that all employees within their business have a right to work in the UK. Employers are expected to retain on file proof of eligibility to work for each employee and conduct ‘illegal working checks’.
There are additional reporting and recording duties on businesses that hold sponsorship licences. These have to be managed regularly through the Sponsorship Management System.
