If you have been injured in an accident in the last three years and someone else was to blame, you may be able to claim compensation.

The three year time limit does have exceptions:

  1. If you were under 16 on the date you sustained injury, the three years only starts to run from your 16th birthday. This means you can claim up to your 19th birthday.
  2. If you did not realise at the time of the accident that you had been injured, then the three years may start to run from the day you found out you were injured. An example of this is hearing loss as a result of a noisy workplace. The hearing loss will not be apparent on the first day you begin working in a noisy workplace but will only appear over time.
